Participation Agreement

I voluntarily agree to assume all of the risks and hazards that Participant may experience or incur in connection with Participant’s attendance of Tod Pod events. I hereby release, covenant not to sue, and agree to hold harmless Tod Pod’s officers, directors, volunteers, and representatives from all liabilities, claims, losses, actions, damages, costs or expenses of any kind arising out of or relating to Participant’s participation in Tod Pod events. I understand and agree that this waiver and release includes claims based on the negligence of Tod Pod.

I understand that Tod Pod collects and holds personal information about children, families and caregivers. Such information may include names, addresses, emails, phone numbers, birthdays, ages, and ethnicities.

Why does Tod Pod collect personal information? For day-to-day administration planning purposes, and in order to seek funding, by aggregating blind information for use in funding applications.

When would Tod Pod share my personal information? Tod Pod will only use or disclose information without an individual’s consent if Tod Pod reasonably believes such use or disclosure is necessary to reduce or prevent a threat to a person’s life, health or safety or a serious threat to public health or safety; or the use or disclosure is required or authorized by law.

How does Tod Pod protect my personal information? Tod Pod has steps in place to protect the information it holds from loss, unauthorized access or disclosure, including: password protected access rights to computerized records and use of cloud-based professional software with high levels of security.

I understand and agree that Participant’s photograph and video or audio may be used in any number of marketing purposes and communication vehicles for the promotion of Tod Pod. I release Tod Pod and those acting pursuant to its authority from liability for any violation of any personal or proprietary right I may have in connection with all such recordings and uses. I understand that Tod Pod will take reasonable measures to remove any such multimedia upon request by me.

I understand that Tod Pod does not post its event calendar publicly in an effort to limit its distribution to registered families. I agree to refrain from posting Tod Pod’s event schedules in public or online, including on any social media platform, to protect the safety of participants.
